چکیده
در قانون مجازات اسلامی جنایت بر پلک در دو قالب کلی «ازاله» و «شکافتن» تصویر شده است. علیرغم تفاوت فاحش میان این دو قالب، قانونگذار در ماده 590 و 591، برای هر دو، دیه برابر مقرر کرده است. با وجود اینکه پژوهش‌هایی در زمینه نقد و بررسی مفاد ماده 590 نگاشته شده و پژوهشگران همت خود را صرف مسأله ازاله پلک کرده‌اند، لکن به نظر می‌رسد با توجه به برخی تأملات، بررسی مسأله شکافتن پلک و میزان دیه آن که در ماده 591 بازتاب یافته از ضرورت بیشتری برخوردار است. در این پژوهش ضمن مراجعه به منابع معتبر فقهی و با رویکردی توصیفی - تحلیلی، هم بنای ماده 591 نقد و بررسی خواهد شد و هم مبنای این ماده مورد واکاوی قرار خوهد گرفت. این پژوهش نشان خواهد داد ماده مذکور به جهت ساختار تقنینی و به اعتبار بنای خود دچار ابهام است؛ این ابهام هم در تعبیر «شکافتن» وجود دارد و هم در تعبیر «دیه». علاوه بر این، مبنای اصلی تقریر این ماده روایت ظریف است که به جهات مختلف نمی‌تواند مورد استناد قرار گیرد؛ مضافاً اینکه فتاوای مراجع معظم تقلید تأیید می‌کند که برای شکافتن پلک اساساً دیه ثابت نیست بلکه از موارد رجوع به ارش است.

Diah of Eyelids sliver in jurisprudence and islamic punishment law: A Critical Inquiry into structural and basilar ambiguity in article 591 of Islamic Penal Code
چکیده [English]
in the islamic penal code , the crime on the blinks has been done in two general terms of disappearance and splitting of the image. in spite of the stark contrast between the two formats , the legislator in article 590 and 591 had equal Diah for both . despite the investigation of the provisions of article 590 , researchers have been devoted to investigating the provisions of article 590 . however , it seems that according to some reflections , it is necessary to study the problem of splitting of the eyelids and the amount of blood that are more necessary in 591 - 591 . in this study , referring to valid jurisprudence sources and with descriptive - analytical approach , the sample of 591 will be reviewed and analyzed and the basis of this article will be analyzed . this study will show that the material is ambiguous because of the legislative structure and its structure validity . There is ambiguity in the interpretation of " sliver " and it is in the interpretation of "Diah" . moreover , the original basis of this article is a subtle narrative which cannot be invoked in many ways ; Furthermore , the views of the mimicking authorities confirm that it is not stable to split the eyelid basically . but of reference to Arash.
