چکیده

اقرار در فقه و حقوق همواره مورد توجّه بوده است. در قانون مجازات اسلامی، قانونگذار به کرّات از اقرار به ارتکاب جرم به عنوان یکی از ادله اثبات جرم سخن گفته است. این دلیل در مقایسه با سایر ادله اثبات جرم، همزمان می تواند به عنوان بهترین و بدترین دلیل شناخته شود. بهترین دلیل است از این جهت که دادرس می تواند بر اساس آن و بدون هیچگونه تردیدی راجع به رفتار و مسؤولیت متّهم اظهارنظر نماید؛ از اینرو، در حقوق جزای عرفی، اقرار را به عنوان شاه دلیل می شناسند. با این همه، اقرار می تواند بدترین دلیل در بین ادله اثبات جرم باشد چرا که ممکن است طریق تحصیل آن نامشروع و غیر قانونی بوده باشد. چنان که بعید نیست اقرار صورت گرفته، متضمّن شرایط لازم برای سلامت آن نباشد، یا مثلاً در اثر تهدید و شکنجه حاصل شده باشد. طبیعتاً اقراری که بدون رعایت شرایط موردنظر قانونگذار و شارع مقدّس صورت گرفته باشد در فرآیند کیفری پذیرفته نیست، امّا در مقابل، چنان چه اقرار متضمّن تمامی شرایط مدّنظر قانونگذار باشد آثاری را به دنبال خواهد داشت که در فرآیند کیفری حائز اهمیّت است. در این مقاله، با بررسی شرایط لازم برای صحّت اقرار بر اساس قانون مجازات اسلامی سعی کرده ایم آثار مترتّب بر اقرار صحیح را مورد مطالعه قرار دهیم.

Territory of Authenticity of Confession in Iranian Islamic Penal Code

چکیده [English]

Confession has always been considered in law and jurisprudence.In the Penal Code the legislator has repeatedly spoken about the confession as one of the proofs of evidence. This proof  compared with the other proofs of evidence can be recognized as the best and worst proof. It is the best proof because the judge could decide without any doubt concerning the behavior and responsibility of the accused.  Therefore, in conventional criminal law the confession is known as a king proof. Nevertheless, the confession can be the worst proof because it may be achieved illegitimately and illegally. As it is not unlikely that confessions may be obtained by torture or threat. Naturally, the confession without observing the conditions required by the Common and Divine legislator was not accepted in the criminal process. But, in return, if the confession involves all conditions considered by the legislature, some results will follow which is important in the criminal process. In this article, by reviewing the conditions necessary for the veracity of the confession according to the Penal Code, we have tried to study the effects associated with the correct confession.
