چکیده
کمتر روزی است که شاهد وقوع حوادث گوناگون برای وسایل نقلیه به ویژه تصادف و حجمی کم یا زیاد از ضایعات حاصل از آن نباشیم. ضایعاتی که گاه تا ساعت ها یا روزها رها می‌شوند و بعضاً حادثه‌ای دیگر آفریده و موجب خسارت مالی یا جانی شخصی دیگر می شوند. داوری در اینباره که مسؤول جبران خسارات حاصل از این ضایعات کیست و مسؤولیت او بر چه مبنایی استوار است، با توجه به عدم وجود مقررات صریح در این زمینه،کاری دشوار می‌نماید. از سوی دیگر، عدم جبران خسارت زیاندیده نیز عقلاً نه مقبول شارع است و نه قانونگذار. با عنایت به گستره مسأله و وضعیت قوانین و مقررات مربوط، اصلاح یا تکمیل ماده ۱۰ قانون اصلاح قانون بیمه اجباری مسؤولیت مدنی دارندگان وسایل نقلیه زمینی در برابر اشخاص ثالث به نحوی که صراحتاً و به دور از هر گونه ابهام، جبران خسارات موضوع مقاله حاضر را پوشش دهد ضروری به نظر می رسد.

Wastage of Driving Accidents and Compensation of its damages

There are few days when we do not witness a number of driving accidents specially collisions with an amounts of wastage resulting therefrom. Wastage which Sometime are left unattended to for hours, even days, causing more accidents and losses. Who is liable for later losses caused by the earlier damages and what is the basis of liability, is something difficult to decide particularly because of lake of express regulations in this case. So, considering the field of the issue and the content of concerned Acts and regulations, it is recommended that article 10 of amending Act of the Act for compulsory insurance of civil liability of terrestrial vehicles against third parties, is amended or completed in some way that covers clearly the losses and damages involved in this research.
