چکیده

مِسیار (بر وزن مفعال) نکاحی است که اخیراً در برخی کشو رهای عربی رواج یافته
و علیرغم ترویج روزافزون آن در جوامع اهل سنت، در میان فقهای ایشان درمورد ماهیت و
مشروعیت آن اختلاف نظر است. این ازدواج به صورت دائم منعقد م یگردد و زوجه با
رضایت تام از برخی حقوق خویش صر فنظر می کند تا بتواند خود را با شرایط آن ازدواج
وفق دهد. حق نفقه، مبیت و حق مسکن از حقوقی است که زوجه از آن صر فنظر می کند.
زوجه در ازای اسقاط این حقوق تا حدودی در زندگی خویش آزاد است. در این ازدواج مرد
می تواند بدون محدودیت در زمان دلخواه نزد همسرش برود. فقدان ازدواج موقت در نظام
فقهی و حقوقی جوامع اهل تسنن، آنان را به سمت ازدوا جهایی نظیر مسیار سوق داده است
تا به نحوی جبرا نکننده ضر رهای ناشی از تحریم متعه باشد. ارزیابی فقهی نکاح مسیار در
مذاهب اسلامی، تبیین شروط مورد تراضی در آن، مقایسه آراء فقها و استدلالات ایشان و
در نهایت، تقویت و استفاده از نظر برتر، از اهدف این مقاله است.

چکیده [English]

Mesyar is a marriage that recently have been common in
some arabic communities and regardless expanse in sunnite
communities, about nature and legitimation of that in thire
jurisprudents is difference of opinion. the marriage contract is
permanently and wife with the full consent ignore her some
rights in order to adapt to conditions of marriage. right of
alimony, intercourse and housing are rights that woman
ignore them. Instead of waiver, woman is quantitative free in
her life. man In this marriage can go to his wife without
limitation in desired time. Absence of temporary marriage in
the system of legal jurisprudence sunnite communities, has
led them to marriages such mesyar way to compensate for
losses caused by the forbidden to be temporary marriage.
jurisprudential pondering mesyar marriage in islamic
religious, explaining of agreed conditions, comparison of
views and arguments of jurists, eventually invigoration and
operation of superior viewpoint are aims of this article.
