Alongside the expansion of social networks, the phenomenon of child influencers has also witnessed significant growth in recent years. These are children who engage in digital content creation without independent decision-making power and under the direction of their parents. Parents often justify their use of children in this sphere by claiming that the child’s presence in digital spaces is primarily recreational and, at the same time, provides an opportunity for the expression and development of their talents. Given that, according to the teachings of Islamic jurisprudence and the international human rights system, any action or decision concerning children is contingent upon consideration of their best interests, this study, employing a descriptive-analytical and comparative method, seeks to examine the compatibility of utilizing children as influencers with the elements of the best interests principle recognized in Islamic jurisprudence and the international human rights system.
The findings indicate, first, that employing children in the capacity of influencers constitutes a clear instance of digital exploitation and abuse. Second, from the perspective of Islamic jurisprudence, such conduct conflicts with the components of the child’s best interests, including the prevention of harm, the attainment of benefits, and the fulfillment of the child’s material, moral, and psychological needs. Third, this practice is inconsistent with the criteria for assessing the best interests of the child as articulated in international legal instruments. Therefore, utilizing children as influencers for the purpose of content creation is considered, both from the perspective of Islamic jurisprudence and the international human rights system, an act beyond the lawful scope of parental authority and lacking legal legitimacy. This, in turn, necessitates the adoption of legal measures at both national and international levels to protect child influencers.
