Sustainable development in the northern provinces of Iran—Gilan, Mazandaran, and Golestan—faces significant environmental and legal challenges. Despite being among the most ecologically sensitive and rainfall-rich regions of the country, the absence of an integrated waste management strategy, lack of standard wastewater treatment plants, leachate infiltration into groundwater, and the widespread practice of burning mixed waste have placed these areas at serious environmental risk. This study aims to provide a legal pathology of the current situation and explain the necessity of establishing wastewater treatment plants and implementing source-based waste separation. The research adopts a qualitative methodology, relying on documentary analysis of national environmental laws, governmental reports, scientific literature, and international standards. The findings reveal a substantial gap between the existing legal framework—including the Environmental Protection and Enhancement Act (1974), the Waste Management Act (2004), and Article 50 of the Constitution—and their actual implementation. Institutional weakness, insufficient budget allocation, poor municipal capacity, and the dominance of construction-oriented policies over environmental priorities have undermined sustainable development in the region. Budgetary analyses demonstrate that while constructing waste-to-energy facilities in Gilan required approximately one thousand billion tomans in 2019, the government allocated over six thousand billion tomans to new dam construction, indicating a misalignment between environmental needs and fiscal priorities. The study concludes that the current state of waste and wastewater management in northern Iran is incompatible with the principles of sustainable development, the preventive and precautionary principles in environmental law, and international best practices. To address this crisis, the research recommends the establishment of integrated waste management systems, mandatory source-based waste separation, reform of environmental budgeting frameworks, strengthening institutional supervision, and the immediate construction of municipal wastewater treatment plants. These measures are essential to preventing further ecological degradation and ensuring long-term environmental sustainability in the northern provinces of Iran.
