There is disagreement among jurists about concomitant of limited Punishment and Forbidden Rules. This effects on criminalization of wine. Some have proven this connection. So, all intoxicants have been criminalized as crimes with limited Punishment. Others do not accept this view. - Which can be considered the view of most of the contemporaries - there is no connection between limited Punishment and Forbidden Rules. This article studies on two points of view. From the results of the second view, Legal principles such as interpretation are in favor of the accused. Hudud topics are one of the most important chapters of penal jurisprudence, which Islamic law pays special attention to, because these topics are related to the most basic crimes that have the most negative effects on the health of the individual and the society. Considering jurisprudence rules such as Dara's ruleit seems that a review is necessary in this debate.
