Freedom to receive and disseminate information is recognized as a fundamental human right in the international human rights system. However, this right is not absolute, as its unrestricted exercise may lead to misuse and raise concerns. Therefore, the free flow of information has always been accompanied by certain principles, regulations, and, in some cases, limitations. This study, based on an analytical-descriptive approach, shows that according to human rights instruments, freedom of information is exercised within a defined legal framework and subject to specific principles.
Among the most important principles governing the free flow of information are the principle of equality of states in access to and use of information resources, the principle of non-interference in the affairs of other states during the process of receiving and disseminating information, the principle of peaceful use of the free flow of information, and the principle prohibiting abuse of the right to receive and disseminate information. These principles are intended to prevent violations of others’ rights and ensure the legitimate exercise of this right.
Alongside these principles, certain limitations are imposed to protect individual and social rights. Some restrictions aim to safeguard social interests such as national security, public welfare, public order, and fair moral considerations. Others are designed to protect individual rights, including fundamental freedoms, privacy, property rights, and similar concerns.
However, these limitations are only valid and enforceable when they conform to the standards of democratic societies and are established within domestic law. Therefore, freedom to receive and disseminate information is a fundamental right, but one subject to principles and limitations intended to prevent abuse and protect public interests as well as individual rights.
