A comparative study of the possibility of claiming damages of Breach of contract in Imamiye jurisprudence, Iranian law and international documents

Abstract

With the realization of the contractual responsibility, the person who caused damage to another (the obligor) by violating the terms of the contract (the obligor) is considered responsible for compensation and the result of this is that the person who suffered the damage will be able to refer to the competent courts. and filing a claim for damages from him to demand damages, and the law compels the cause of damages to compensate. The possibility of claiming damages due to breach of contract is one of the methods of compensation for damages or guaranteeing the performance of breach of contractual obligations, which is in Imamiyyah jurisprudence, Iranian law and Islamic law. International law has been predicted. But in this field, there are differences between the domestic laws and the mentioned documents. Among other things, the possibility of claiming loss of profit and possible damage is considered in these documents.
