A different look at the prevailing conditions in the Islamic government

Abstract

A brief review of jurisprudence books shows that all the jurists - both ancient and contemporary - have mentioned "maturity", "reason" and "justice" - which means abandoning sin - as the conditions of the Islamic ruler, and this article completely denies the above three conditions and claims that the above conditions are either derived from an incorrect view of the issue and considering it superficial, like the first two conditions, or it was created from inaccuracy in the evidence, like the last condition; Therefore, conditions such as "elite and sophistication" and "social justice" - which do not necessarily mean giving up sin - should be put forward. In order to prove the above claim, this research, while criticizing the views of the jurists regarding the prevailing conditions and analyzing the narrations cited by them, explains Mukhtar's saying that social justice is necessary and the condition of being an elite, and examines its evidence.
