Exploring the Range of Claims That Can be Proven with a Single Witness and the Claimant's Oath

Abstract

One of the ways to prove a claim in Imamiyyah jurisprudence is "single witness and oath".The principle of proving a dispute with a single and sworn witness is common among jurists, but the existence of traditions with different expressions has caused disagreements among jurists regarding the scope and scope of validity of this compound evidence. A group of views assigning such a reason to the absolute debt, a group of the view assigning it to the absolute rights of people and famous jurists have chosen the view of assigning it to the absolute property and everything that is meant by that property. The legislator has followed the famous theory in Article 209 of the Civil Code and Clause "B" of Article 230 of the Civil Code as well as Article 277 of the Civil Code. Since the present essay has not found Mukhtar Mahmood free of controversy, Considering the importance of the problem, by adopting descriptive-analytical method, while counting the statements in the problem, the documentation of each point of view has been analyzed and criticized, and in the end, it has come to the conclusion that a strong and acceptable theory, the ability to prove absolute human rights It is with the same witness and Yamin, and the competing statements, especially the popular opinion, are not able to prove their claim due to the weakness of their documentation. Therefore, it is suggested to amend the aforementioned laws according to Mokhtar's point of view.
