Jurisprudential-Legal analysis of the Criteria for Recognizing the Crime of Stealing Other People's Property

Abstract
In the enforcement of the fourth principle of the constitution that the laws and regulations are Islamic, the Iranian legislator has also tried to comply with this principle in the criminal sections related to the crime of theft. Explanation: In order to apply the h.add punishment to theft, the Imami jurists have calculated the conditions, in case of its absence, the committed behavior is covered by other jurisprudential titles and the reason for determining Ta’azir for the perpetrator. Unfavorable performance of the legislator in reflecting the Sharia principles mentioned in the criminal laws has caused ambiguities and mixed interpretations among lawyers and criminal courts regarding the abduction of Article 665 of the Punishment Law approved in 1375. It seems that the most important existing challenge is the lack of regulations and legal criteria to recognize and identify examples of the mentioned legal article, due to the lack of differentiation in the constituent elements of the crime of snatching, the subject of this article and the crime of theft; The research method in this article is analytical and descriptive, and it aims to, in the legal and jurisprudential analysis, identify the criteria and rules for distinguishing the cases of Article 665 and the components of its differentiation from the crime of theft in the context of the concept of Sharia, legal and customary ownership of the property subject to snatching.
