Criticism and Evaluation of the Argument to "Right holder's Tashaffi" as the Apparent Motive of Qisas

Abstract
In jurisprudential books across diverse schools, the recurrent assertion is that the Qisas law is instituted to provide Tashaffi, signifying peace of mind for the right holder. Given that this statement forms the basis for some crucial arguments in discussions related to crimes, its examination is essential and significant. The present research evaluates the mentioned claim from the perspectives of legal precedents and empirical studies in psychology. Neither Quran verses nor Hadiths provide evidence supporting the acceptance of Tashaffi as Apparent Motive of Qisas. According to psychological research findings, the execution of Qisas, though satisfying for the the right holder, cannot necessarily bring tranquility to the victim or their heirs. Consequently, despite its prevalence, this proposition appears unfounded and inappropriate for legal inferencing. The prevalence of this perspective emanates from two main sources: firstly, the consideration of the issue of retribution from an individual jurisprudential standpoint, and secondly, In this perspective, the absence of empirical research has led to the assumption that the satisfaction derived from the execution of Qisas equates to Tashaffi following Qisas.
