Study and Critic of Article 256 and 257 of the Islamic Penal Code (The unity of the accuser and the plurality of the accused)

Abstract

According to the opinion of the most jurists, which is expressed in the articles 256 and 259 of the Islamic Penal Code, if a person accuses several people separately of adultery and the like, and the accused file a lawsuit and ask for punishment, the criminal is sentenced to several punishments. Also, if someone accuses several people of adultery and the like with a single word and they file a lawsuit and ask for punishment separately the criminal is sentenced to several punishments. This article, using the library method, has reached the following conclusions by criticizing the evidence of the theory of most jurists: The opinion of famous jurists is considered an interpretive theory based on their interpretation of some hadithes; but the Quran and traditions do not explicitly confirm it. In addition, it will be very difficult to implement this opinion in some cases, such as where the defendant has accused many people of adultery, for example, the residents of a region, because the accused may be sentenced to thousands of lashes. Finally, this article has preferred another interpretation of hadithes.
