The rights of disabled criminals in the Iranian penal system

Abstract

Disabled people are among the most vulnerable groups in society and are always at risk of having their rights violated. Therefore, numerous efforts have been made at various national and international levels to achieve their rights. One example of the rights of people with disabilities is their rights in the criminal justice system. People with disabilities, like other people, may commit crimes, but given their problems, they should not be treated like ordinary people. Rather, a differentiated penal policy based on positive discrimination should be adopted towards them. Considering this issue, the purpose of this study is to examine the rights of disabled criminals in the Iranian penal system. The findings of the research, which was conducted using a descriptive-analytical method, indicate that the rights of the disabled were poorly addressed in the Iranian penal system before. 2023 (1402) In general, currently in Iran , disabled criminals enjoy various rights, including the right to an interpreter and expert, the right to a free legal aid lawyer, the right to reduced sentences and alternative punishments fact to imprisonment.
