Feasibility study of the right of recommendation for the executor in an absolute testamentary will

Abstract

Sometimes, the executor may not make any statement in a testamentary will about whether the executor has the right of recommendation or not, and may consider the will absolute in this respect; since, in some cases, due to the insufficiency of the person’s life span or the extent of the testator’s wills or the testator’s minor children who are responsible for them not having reached the stage of maturity; a person cannot enforce all of the testator’s wills; In order to execute the remaining wills, someone else must be responsible for them; now, in such circumstances, the question arises as to whether the executor has the right to appoint a successor to carry out the remaining wills; that is, is there a possibility of choosing a second executor to succeed him? Studies indicate that the jurists differ in their opinions on this issue, such that the most famous jurists believe that appointing a successor is not permissible for the executor, and some have also made a distinction between minor marriage and other wills, ruling that appointing a successor is permissible in the first case and not permissible in the second. The third opinion also absolutely believes that appointing a successor is permissible in the present issue. Reading the jurisprudential foundations of the issue indicates that the third view has a strong point and is more defensible. Since the legislator, following the well-known view, has only considered delegating the right of recommendation to the executor in the event of the testator's permission, in the event of lack of permission, the executor does not have the right to delegate recommendation, and the lack of permission of the executor also includes cases of prohibition of the executor and the validity of the will contract; amending the aforementioned article and ruling on the permissibility of recommendation in the event of the validity of the will contract, in line with the unpopular view, is recommended to the customary legislator.
