Abstract
Acquiring the rules of national and international environmental laws in the field of environmental damage and knowing the necessary environmental rules and interaction of the two with the aim of improving the status of the environment and most importantly, the effective aspects of valuing human environmental rights are some goals that have been pursued in the shadow of studying national and international documents and observing legislative and executive gaps and extracting these gaps. Recognition from a legal point of view by observing procedural elements (access to environmental information, public participation in environmental decision-making and access to justice), and the substantial elements (clean air, safe climate, healthy and sustainable food, access to sufficient safe and hygienic water, non-polluted work and entertainment environments, healthy habitat and biodiversity) is one of the ways to recognize environmental human rights. Passing a resolution that recognizes the right to enjoy these rights will be a positive approach to accelerate efforts to ensure their enjoyment. An approach that is right-oriented and subject to immediate measures that are possible in the shadow of the interaction of all legislative, executive and judicial powers.
