Feasibility of eliminating usury from the concept of interest in the United Nations Convention on Contracts for the International Sale of Goods

Abstract
The provision of the right to claim interest on the price in the United Nations Convention on Contracts for the International Sale of Goods, known as the 1980 Vienna Convention, has caused many Islamic countries not to welcome it. In the case of Iran, although it cannot be said that it was not joined because the Iranian legislator has not yet paid attention to it to find out what its position is, the rule of Islamic Sharia over the country on the one hand, and the existence of the law on the sanctity of usury in Imami jurisprudence on the other hand, it makes challenges to the legislator on illegitimacy. It is obvious that in case of compliance with the desired interest, joining it will be ruled out, but based on justifications that will be discussed, it can be considered excluded from the scope of usury. Statements such as interest as a compensation for the decrease in the value of the price, interest as a compensation for the lost value of the price, responsible interest based on the principle of Ala- alyad, the conceptual absence of riba with it, and the theory of the disrespect of inferential usury are things that can be inferred based on them. The upcoming research, with a brief introduction of the scope of interest in the convention and also a brief look at the determination rule, examines its exclusion from the scope of usury prohibited by Sharia based on the aforementioned principles.
