چکیده
نکاح مسیار و نکاح دوستان از عقود نکاح نوینی هستند که در سال‌های اخیر مطرح شده‌اند و فقها و اندیشمندان معاصر پیرامون صحت و مشروعیت آ‌ن‌ها اختلاف نظر دارند. در نکاح مسیار زن از حق نفقه، هم‌خوابگی و سکونت مشترک با مرد صرف‌نظر می‌کند و مرد نیز ریاست چندانی بر وی ندارد. این نکاح در حال حاضر در کشورهای عربی حوزه‌ی خلیج فارس و افغانستان به شدت در حال گسترش است حتی سایت‌هایی نیز با عنوان مسیار وجود دارد که این نکاح را تبلیغ می‌کنند. اما نکاح دوستان نکاحی است که در آن دو دوست (پسر و دختر) به منظور مشروعیت بخشیدن به روابط فی مابین آن را منعقد می‌کنند و زوجه در منزل پدری خود باقی می‌ماند. در این نوشتار، ابتدا نکاح های نوین معاصر را معرفی می‌کنیم؛ سپس اسباب پیدایش آن‌ها را بر می‎شمریم و در نهایت مشروعیت، مزایا و معایب آن‌ها را بررسی می‌کنیم.

Abstract
Mesyar marriage and friend marriage are among the modern marriages introduced in recent years. Jurisprudents and thinkers have different opinions regarding the correctness and legitimacy of these marriages. In mesyar marriage the wife ignores alimony, sexual partnership and the right to live with a man while he has not much authority over her. This kind of marriage is spreading fast in Arabic countries of Persian Gulf and Afghanistan and there are some internet sites propagating it. Friend marriage is practiced to legitimize the relation of two friends (opposite sex). In this kind of marriage the wife stays in her father’s house. The present paper first introduces the modern marriages, then discusses the reasons behind their emergence and finally their legitimacy, advantages and deficiencies are analyzed.
