Since many laws in the world do not have the same efficiency and effectiveness in cyber space, it is possible to easily violate them without the worry of facing criminal and non-criminal responses. Anticipating criminal sanctions in new fields such as information and communication technology, in addition to the protection and stability of order and security of the society, also provides the human rights standards of citizens. It is obvious that the effectiveness of the criminal and non-criminal sanctions regarding the offenses Virtual space depends on deep, wide and multi-dimensional research, but before this, there was less research about the efficiency and effectiveness of the responses mentioned in this field, as well as providing a perspective of a suitable criminal and non-criminal response system. Therefore, with the aim of obtaining the desired response, this research has been written with a descriptive-analytical method and using library and internet resources. According to the results of this article, it is necessary to use the capabilities of the restorative justice model to grow the efficiency and effectiveness of the guarantee of criminal executions. یکی از چالش هایی که جامعه بشری به طور جدّی با پیامدهای آن دست و پنجه نرم می کند و روز به روز بر مشکلات ناشی از آن افزوده می شود، نوآوری های مجازی  از سوی بزهکاران سایبری است. از آنجا که بسیاری از قوانین در جهان مادی، از همان کارآیی و اثربخشی در فضای مجازی برخوردار نیستند، امکان نقض آسان و عاری از دغدغه ناشی از مواجهه با پاسخ های کیفری و غیر کیفری میسّر گشته است. بدیهی است که بهره وری ضمانت اجراهای کیفری و غیر کیفری  در خصوص بزه های ارتکابی در فضای مجازی، در گرو پژوهشی عمیق، گسترده و چندبعدی می باشد؛ لکن از آنجا که راجع به کارایی و اثربخشی پاسخ های مذکور در این زمینه و همچنین ارائه دورنمایی از یک نظام پاسخ دهی کیفری و غیر کیفری مناسب، تحقیق کمتری صورت گرفته است تحقیق حاضر به روش توصیفی - تحلیلی و با هدف احراز پاسخ دهی مطلوب نگارش یافته است. مطابق نتایج این نوشتار، با امعان نظر به شرایط خاص حاکم بر فضای مجازی، ویژگی های شخصیّتی کنشگران انواع جرایم سایبری و میزان گسترده زیان های مادّی و معنوی، علاوه بر ضرورت اصلاح و بازنگری نظام مند قوانین کیفری اصلی و مرتبط با جرایم رایانه ای، استفاده از قابلیّت های الگوی عدالت ترمیمی برای رشد کارایی و اثربخشی ضمانت اجراهای کیفری ضرورت دارد. https://feqh.semnan.ac.ir/article_7107_2931dd380306281a138ea8714b93d887.pdf
