The obligor will be exempted of the obligation in case of acting upon the contract contents or the distinctiveness and conditions within it. In other words, it should take place in the exact agreed time and place stated in the contract context, and in case of any expense, it will be up to the party to whom the contract refers. However, in some cases, the contract might be unconditional in terms of time, place, and any expense of fulfilment of the obligation. This issue has drawn the jurists’ attention and has been subjected to lots of disagreements and debates in various assumptions. <br />This paper, concludes that except for the revocable contract in which time is not estoppel, in the unrestricted contract, the principles of obligation immediate payment, obligation fulfillment in the place of ratification, and payment of the obligation fulfillment expenses by the party benefited from it, are the basic foundations to answer the questions in the all legal and lawful and jurisprudential parts. عقد و ایقاع اعمّ از این که لازم یا جایز باشد، تعهّداتی را موجب می­ شود که متعهّد ناگزیر از ایفای آن است. ایفای تعهّد زمانی ذمّه­ متعهّد را بریّ می­ سازد که طبق مفادّ عقد، از حیث اوصاف و شرایط مقرّر واقع شود؛ به این معنا که الزاماً باید در زمان و مکان مورد توافق در متن عقد صورت پذیرد و در فرضی که انجام تعهّد، متضمّن هزینه باشد بر عهده طرفی خواهد بود که در ضمن عقد به آن تصریح شده است. اما گاه به جهاتی ممکن است عقد از حیث زمان، مکان و هزینه وفای به عهد، مطلق باشد. این مسأله مورد توجه فقیهان قرار گرفته و اختلاف نظرها و بحث ­های متعدّدی را در فروض مختلف به همراه داشته است.<br /> بر اساس یافته­ های این نوشتار، جز در عقد جایز که زمان، الزام­آور نیست در فرض اطلاق عقد، اصل تأدیه فوری تعهّد، اصل انجام تعهّد در مکان انعقاد و اصل پرداخت هزینه انجام تعهّد توسّط طرفی از عقد که تأدیه به مصلحت او صورت می پذیرد، مبنای پاسخ به مسائلی است که در کلیه ابواب فقهی، حقوقی و قانونی قابل طرح است. https://feqh.semnan.ac.ir/article_3137_99a448e6db0a6d7364fe4d5bf2bdb186.pdf
