There are two consequences for this matter: firstly, the husband does not commit any sin as a result of his murder in front of God and will be not punished in the other life (Hereafter). Secondly if he proves this situation, he will be exempted of Retaliation and Ta'zir. Article 302 of Islamic Punishment Code (2014) has excepted the murder of wife and the alien by husband from the Retaliation adherence to the famous opinion of Imami Jurists. The right opinion in this matter is the relativity of the murder in the Marriage Bed as a defense, so most of the terms for considering it as a Hadd are not valid. In this research we have studied the famous opinion of jurists and its analyzing with an analyzing- critical approach. Also we have studied in Penal Law. قتل در فراش، جایی است که شوهری، همسر خود و مردی اجنبی را در حال ارتکاب زنا با یکدیگر مشاهده نموده و سپس مرتکب قتل ایشان گردد. برای این موضوع دو اثر ذکر نموده‌اند: اولاً- شوهر در چنین صورتی بین خود و خدایش، به خاطر قتل، مرتکب گناهی نشده و در آخرت عذاب نمی‌شود، ثانیاً- اگر این امر را به ­نحو صحیح اثبات کند، از قصاص و دیه معاف می‌شود. در اهمیّت این بحث باید متذکر شد که ماده 302 قانون مجازات اسلامی 1392 نیز به تبعیت از قول مشهور فقهای امامیه، قتل زوجه و زانی توسط شوهر را مستثنی از قصاص دانسته‌ است. نظر صحیح آن است که قتل در فراش از باب دفاع و مهدورالدم نسبی بودن است، لذا عمده شرایط ذکر شده که آن را مصداقی از اجرای حدّ می­داند، اعتباری نخواهد داشت. در این پژوهش با رویکرد تحلیلی- انتقادی به بررسی نظر مشهور فقها و نقد آن، همچنین قتل در فراش در حقوق کیفری پرداخته شده است. https://feqh.semnan.ac.ir/article_1963_673fc9c4346a797208cfb87baa5c9516.pdf
