The present study has attempted to resolve the aforementioned challenge by examining various cases of inheritance shares of women and men, examining the concept and instance of justice, and considering the different occasions of financial responsibility in the family institution, and has concluded that these differences do not necessarily mean discrimination and violation of justice. Violation of justice due to differences in inheritance shares is dependent on us defining justice in the sense of equality and similarity, while this definition itself entails violation of justice and ignoring appropriate and necessary differences. The difference in inheritance shares is, first, proportional to the difference in financial responsibility, which is aimed at the future of the son as a spouse and is in fact aimed at financially supporting the wife and family. Second, the difference in inheritance shares is in some cases in favor of women, and sometimes there is no difference. Therefore, the differences cannot be considered to be due to gender discrimination and violation of justice, but rather indicate a specific style in the politics of the financial system and family management in Sharia. دو برابری سهم الارث پسران نسبت به دختران ممکن است نوعی تبعیض جنسیتی و مالی قلمداد شده و از منظر عدالت حقوقی، فقه اسلامی را با چالش روبه رو کند. تحقیق حاضر با بررسی موارد گوناگون سهم الارث زنان و مردان و دقت در مفهوم و مصداق عدالت و مد نظر قرار دادن مناسبت‎های متفاوت مسئولیت مالی در نهاد خانواده به حل چالش مزبور اقدام کرده و به این نتیجه رسیده است که این تفاوت‎ها لزوما به معنای تبعیض و نقض عدالت نیست. نقض عدالت به واسطة تفاوت در سهم الارث منوط به آن است که عدالت را به معنای تساوی و تشابه معنا کنیم، در حالی که این تعریف، خود مستلزم نقض عدالت و نادیدن تفاوت‎های بجا و بایسته است. تفاوت سهم الارث، اولا متناسب با تفاوت مسئولیت مالی است که متوجه آیندة پسر به عنوان زوج می‎باشد و در واقع در جهت حمایت مالی از زوجه و خانواده است. ثانیا، تفاوت سهم الارث در پاره‎ای موارد به سود زنان است و گاه نیز هیچ تفاوتی وجود ندارد. پس نمی‎توان تفاوت‎ها را ناشی از نگاه تبعیض جنسیتی و نقض عدالت دانست، بلکه حکایت‎گر سبکی خاص در سیاست نظام مالی و مدیریت خانواده در شریعت است. https://feqh.semnan.ac.ir/article_10137_715e8ba46f8bc29c24f3fbfdb8d96d71.pdf
